Consumers of long-term care services, including residents of long-term care facilities, have rights that are guaranteed by state or federal law. A long-term care ombudsman can help if you feel your rights to quality care and respect have been violated. Resident rights by facility type
Nursing Homes and Residential Care (Assisted Living) Facilities
The Ohio Revised Code requires both nursing homes and residential care facilities to:
- Provide sufficient staff to meet your needs on all days and all shifts
- Provide you with reasonable notice before changing your room or your roommate
- Close your door and knock before entering except in case of emergency
- Assist you in rising and retiring in accordance with your requests
- Respond to all reasonable requests and inquiries promptly
- Provide a safe and clean living environment
- Treat you at all times with courtesy, respect, and full recognition of dignity and individuality
Additional residents’ rights for nursing homes and residential care facility residents can be found in the Ohio Revised Code. Additionally, the law provides rights regarding transfer and discharge. Nursing homes are subject to federal law as well; Residential Care Facilities are not.
Residential Facilities Class 2
Residents of Residential Facilities Class 2, also known as Adult Care Facilities or group homes, have rights guaranteed by the Ohio Revised Code including the right to express grievances and speak with a long-term care ombudsman or representative from the Ohio department of mental health and addiction services in private.
Home- and Community-Based Services
Consumers of home- and community-based services should review the client rights relevant to their program or service. Each consumer has the right to be treated in a considerate and respectful manner and be fully informed regarding your care plan and all policies and procedures that impact care and treatment, including the charges for services.
Some of the common home- and community-based services, including the Ohio Home Care Waiver, PASSPORT and the Ohio Assisted Living Waiver program are subject to the person-centered planning rule. Client choices and responsibilities for PASSPORT are also outlined in the Ohio Administrative Code.
MyCare Ohio beneficiaries’ rights are outlined in the three-party contract between the state, the U.S. Department of Health and Human Services, Centers for Medicare & Medicaid Services, and the consumer’s MyCare Plan. In the 2019 Contract, these rights are outlined starting on page 249 (see the attachment).
